Who Should File for Bankruptcy?

When businesses or individuals run into serious financial problems, experienced representation is necessary to help them navigate through the complicated bankruptcy laws. At Adam, Zoldessy, P.C., we help both individual and corporate debtors, as well as representing creditors who help collecting on debts.

We have a full service bankruptcy practice that can assist you at all stages of a bankruptcy proceeding, whether you are a debtor or a creditor. Our lawyers have experience with Chapter 11 and Chapter 13 reorganizations and Chapter 7 liquidations.

Our firm represents both individual and business debtors and creditors in all bankruptcy controversies. As a full-service bankruptcy firm we handle all bankruptcy matters, including:

  • Motions for relief from automatic stay and preference litigation
  • Fraudulent conveyances
  • Motions regarding the use of cash collateral, insolvency and valuation disputes
  • Post-petition financing
  • Reorganization plans and others

Our lawyers offer full-service advice encompassing all aspects of federal bankruptcy law and legislative changes to the bankruptcy process, as well as matters arising under state law affecting bankruptcies such as workouts, negotiations, foreclosures, insolvency, corporate reorganization, and creditors' rights.

Creditor Issues in Bankruptcy

We represent creditors in matters such as objections to claims and exemptions, motions to affirm debts and actions to avoid creditors' liens. We file proof of claims and negotiate debt repayment terms from the debtor. We also prosecute adversary proceedings challenging the dischargeability of someone's debt and objecting to the debtor's overall bankruptcy discharge. We handle other creditor-related bankruptcy matters as well.

Chapter 7, Chapter 11 and Chapter 13

In addition to our creditor services, we work with businesses and individuals who may need Chapter 7, 11 or 13 debtor representation. Unlike some law firms that rush to the Bankruptcy Court doors, we know that the decision of whether to file bankruptcy is as important as filing a well-crafted bankruptcy petition. Before we get to that point, however, we work closely with our clients to make sure that bankruptcy is their best alternative.

Committed to Stress-Free Bankruptcy

After years of representing both creditors and debtors, we remain committed to finding the best solution for each client. We have successfully worked out many issues between creditors and debtors when many firms would have immediately filed with the bankruptcy court. At the same time, when bankruptcy is the best alternative, we are committed to making the process as stress-free as possible.

We are a debt relief agency. We help people file for relief under the Bankruptcy Code.
